Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Squall App Inc. ("SQUALL", "we", "us", or "our"), governing your access to and use of the SQUALL mobile application, website at squallapp.com, and all related services (collectively, the "Service").

By downloading, installing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

SQUALL is operated by Squall App Inc., incorporated under the laws of Canada, with its principal place of business in Ontario, Canada.


2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

SQUALL is not directed at children under 13. If we become aware that a child under 13 has provided personal information, we will delete it promptly.


3. Description of Service

SQUALL is a sailing weather intelligence and race coaching application. The Service provides:

  • Weather forecasts and real-time observations for sailing venues globally
  • AI-generated pre-race briefings and race coaching content ("AI Briefings")
  • Venue-specific historical weather pattern analysis
  • Regatta calendar and session tracking
  • Coach and team collaboration features

Important — Nature of Weather Information: All weather forecasts, observations, AI Briefings, and related content provided through the Service ("Weather Content") are for informational and general sailing preparation purposes only. Weather Content is not a substitute for official weather warnings, maritime safety alerts, or guidance from national meteorological services.

Weather conditions can change rapidly and unpredictably. SQUALL does not guarantee the accuracy, completeness, or timeliness of any Weather Content. You remain solely responsible for assessing conditions, making all decisions related to your safety on the water, and complying with all applicable maritime laws and regulations.

Important — Class Rules Compliance: SQUALL does not encourage the use of any feature during racing in a manner that would violate applicable sailing class rules. It is your responsibility to understand the equipment rules of your sailing class. Certain features, including real-time data feeds, are restricted to coach roles in recognition of class equipment rules. SQUALL accepts no liability for disqualification, protest decisions, or rule violations arising from your use of the Service.


4. Accounts

4.1 Registration

To access certain features you must create an account. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

4.2 Account Security

You agree to notify us immediately at [email protected] if you become aware of any unauthorised use of your account. SQUALL will not be liable for any loss or damage arising from unauthorised use of your account before you notify us.

4.3 Account Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account if you breach these Terms or if your account is used in a manner that harms the Service or other users.


5. Subscriptions and Payments

5.1 Free Tier

SQUALL offers a free tier with access to standard venue weather data outside of regatta access windows. No payment is required for free tier access.

5.2 Paid Subscriptions

SQUALL offers paid subscription plans and event passes ("Paid Plans") that unlock additional features including AI Briefings during regatta access windows. Paid Plans are billed through Stripe. Current pricing is displayed in the app and at squallapp.com.

5.3 Regatta Access Windows

Certain venue data is restricted to users with an active Paid Plan during a "Regatta Access Window" — the period beginning 7 days before a gated regatta's start date and ending at the close of the final race day. Outside of Regatta Access Windows, venue data is available to all users.

5.4 Billing

Event passes are charged as a one-time payment at the time of purchase. All prices are in United States dollars (USD) unless otherwise stated. You authorise SQUALL to charge your payment method for selected plans and purchases.

5.5 Refunds

All sales are final except where required by applicable consumer protection law. If you believe you have been charged in error, contact us at [email protected] within 30 days of the charge.

5.6 Price Changes

We may change pricing at any time. We will provide reasonable notice of price increases to existing subscribers. Your continued use of the Service after a price change constitutes acceptance of the new pricing.


6. AI-Generated Content

6.1 Nature of AI Briefings

AI Briefings are generated using artificial intelligence systems, including third-party AI models operated by Anthropic, PBC ("Anthropic"). To generate your briefing, certain contextual information — including your venue, session history, sailing class, and role (sailor/coach) — is processed by Anthropic's AI systems.

By using the AI Briefing feature, you consent to this processing. Please review our Privacy Policy for details of what information is shared and how it is handled.

6.2 Limitations of AI Content

AI Briefings are generated automatically and may contain errors, omissions, or inaccuracies. AI Briefings do not constitute professional meteorological advice. You should not make safety-critical decisions based solely on AI Briefings. SQUALL does not warrant the accuracy, reliability, or fitness for purpose of any AI-generated content.

6.3 No Safety Guarantee

AI Briefings are a sailing preparation tool, not a safety system. In severe weather, always consult official meteorological services and follow guidance from race officials, coastguard, and maritime authorities.


7. User Content

7.1 Session Notes and Coach Notes

You may submit text notes, session records, and other content through the Service ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant SQUALL a non-exclusive, worldwide, royalty-free licence to store, process, and display your User Content solely as necessary to provide the Service to you.

7.2 Acceptable Use

You agree not to submit User Content that is unlawful, defamatory, abusive, threatening, obscene, or that infringes any third party's rights. SQUALL may remove User Content that violates these Terms without notice.


8. Prohibited Uses

You agree not to:

  • Use the Service in any manner that violates applicable law or regulation
  • Attempt to gain unauthorised access to any part of the Service or its related systems
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools to scrape, extract, or collect data from the Service
  • Impersonate another person or entity
  • Use the Service to transmit spam or unsolicited communications
  • Interfere with the proper operation of the Service
  • Share your account credentials with third parties
  • Resell or sublicence access to the Service

9. Intellectual Property

9.1 SQUALL's Rights

All intellectual property rights in the Service — including the app, software, AI systems, venue data, briefing formats, and all associated content — are owned by or licenced to SQUALL. Nothing in these Terms transfers any intellectual property rights to you.

9.2 Licence to Use

Subject to your compliance with these Terms and payment of applicable fees, SQUALL grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial sailing purposes.

9.3 Third-Party Data

Weather data provided through the Service is sourced from third-party providers including NOAA, Environment and Climate Change Canada, Open-Meteo, Tomorrow.io, and others. Their respective terms and licences apply to that data.


10. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Anthropic (AI), and weather data providers. Your use of those integrations is subject to the third parties' own terms of service and privacy policies. SQUALL is not responsible for the practices of third-party services.


11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

SQUALL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT ANY WEATHER DATA OR AI BRIEFING WILL BE ACCURATE OR COMPLETE; OR THAT DEFECTS WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of certain warranties. To the extent such exclusions are not permitted, they shall not apply to you.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SQUALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF PROFITS, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL SQUALL'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SQUALL IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

You expressly acknowledge that weather and sailing activities involve inherent risks. SQUALL is a sailing preparation and coaching tool. You accept full responsibility for all decisions made on the water.

Some jurisdictions do not allow certain limitations of liability. To the extent such limitations are not permitted, they shall not apply to you.


13. Indemnification

You agree to indemnify, defend, and hold harmless SQUALL and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any incident or injury arising from your use of weather information or AI Briefings provided through the Service.


14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms shall first be submitted to mediation. If mediation is unsuccessful, disputes shall be resolved by binding arbitration in Toronto, Ontario, under the rules of the ADR Institute of Canada.

Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction where necessary to protect intellectual property rights or confidential information.


15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by push notification, in-app banner, or email. Your continued use of the Service after the effective date of updated Terms constitutes acceptance. If you do not agree to updated Terms, you must stop using the Service and delete your account.


16. General

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SQUALL regarding the Service.

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force.

Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
